Account Responsibilities

• Keep your login credentials confidential
• Notify us immediately of any unauthorized access
• You are liable for all activities under your account
• One account per person (no sharing or multiple accounts)

• Commercial use without explicit written permission
• Interfering with service security or functionality

Subscription Plans

• Free tier with limited features and usage
• Premium subscriptions with full access and advanced features
• Educational and institutional pricing available

Payment and Billing

• Subscriptions are billed in advance on a recurring basis
• All fees are non-refundable except as required by law
• Price changes will be communicated 30 days in advance
• Failed payments may result in service suspension

Cancellation

• No refunds for partial billing periods

SpeakMetry's Rights

• All service content, features, and functionality are owned by SpeakMetry
• Our AI models, algorithms, and assessment methods are proprietary
• Trademarks, logos, and brand elements are protected

Your Rights

• You retain ownership of your speech recordings and responses
• You grant us license to process your data for service provision
• You may export your test results and progress data

License to Use

We grant you a limited, non-exclusive, non-transferable license to use SpeakMetry for personal, non-commercial purposes in accordance with these Terms.

Assessment Accuracy

• AI assessments are estimates and may not perfectly match human evaluators
• Results should be used for practice and preparation, not as official scores
• We continuously improve our models but cannot guarantee perfect accuracy

Limitation of Liability

SpeakMetry's liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination by You

• You may terminate your account at any time through account settings
• Cancellation takes effect at the end of your current billing period
• You may request data deletion in accordance with our Privacy Policy

Termination by SpeakMetry

• We may suspend or terminate accounts for Terms violations
• We may discontinue the service with 30 days' notice
• Immediate termination may occur for serious violations

Effect of Termination

• Access to the service will be immediately revoked
• Your data will be handled according to our Privacy Policy
• Provisions regarding intellectual property and liability survive termination

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SpeakMetry.

Assignment

You may not assign your rights under these Terms. SpeakMetry may assign its rights without restriction.

Waiver

No waiver of any term will be deemed a further or continuing waiver of such term or any other term.
